Terms of Service

These Terms govern access to and use of CallCatch AI. They also contain the customer-care SMS terms for consumers who interact with CallCatch-enabled service businesses.

1. Acceptance of Terms

By accessing or using CallCatch AI, creating an account, or purchasing a subscription, you agree to these Terms. If you use CallCatch for a business or other organization, you represent that you have authority to bind that organization. If you do not agree, do not use the service.

2. Description of CallCatch

CallCatch AI is software operated by Call Catch LLC that helps service businesses route calls, follow up on missed calls when valid SMS consent exists, communicate about service requests, collect lead details, and notify business users. Features may depend on the customer’s plan, configuration, and third-party services.

CallCatch is a communications tool. It is not a law firm, compliance certification service, emergency service, or substitute for a business’s own judgment and customer-service responsibilities.

3. Accounts

Business customers must provide accurate account and business information, protect login credentials, and promptly update information that affects call routing, messaging, billing, or service delivery. You are responsible for activity under your account and for notifying us of suspected unauthorized use.

4. Acceptable Use

You may not use CallCatch to:

  • Break the law or violate carrier or platform requirements.
  • Send spam, unsolicited promotions, or deceptive messages.
  • Harass, threaten, discriminate against, exploit, or impersonate another person or business.
  • Bypass consent, opt-out, account-security, usage, or technical safeguards.
  • Upload malicious code, interfere with the service, probe for vulnerabilities without authorization, or misuse third-party systems.
  • Use the customer-care messaging program for promotional marketing without a separate lawful basis, appropriate consent, and supported campaign configuration.

5. Customer Responsibilities

Service businesses using CallCatch are responsible for their customer relationships, services, representations, and legal obligations. They must use accurate business and sender information, configure forwarding and messaging appropriately, obtain and preserve any consent required for their communications, honor opt-outs, and ensure their use of CallCatch is lawful.

Customers must review automated communications and lead information as appropriate. CallCatch may suppress messaging when consent evidence, account status, or other required conditions are missing; customers may not attempt to defeat those safeguards.

6. SMS Messaging Terms

Program / Brand: CallCatch AI

These are customer-care and transactional messages—not promotional marketing messages under this program.

Purpose. CallCatch AI provides customer-care messages related to a consumer’s interaction with a CallCatch-enabled service business. Messages may include missed-call follow-up, questions about a service request, customer-support communications, and related transactional messages.

Consent. Consumers receive automated text messages only after providing applicable affirmative consent. In the standard verbal/IVR flow, a caller hears the SMS disclosure and presses 1 to agree. A phone call by itself is not consent to receive SMS messages. Consent to receive SMS messages is not a condition of purchasing unrelated goods or services. A caller may decline SMS consent—or provide no response—without preventing the underlying call or service interaction from continuing.

Frequency. Message frequency varies.

Rates. Message and data rates may apply.

STOP. Reply STOP to opt out. After an opt-out is processed, no further non-required messages will be sent for the applicable program unless the consumer later provides new consent.

HELP. Reply HELP for help. Consumers may also contact support@getcallcatchai.com.

Privacy. Mobile information and SMS consent are handled as described in our Privacy Policy.

Carrier liability. Carriers are not liable for any delayed or undelivered messages.

Delivery. Message delivery is subject to carrier and network availability and is not guaranteed.

7. Third-Party Services

CallCatch depends on third-party services for functions such as telecommunications, messaging, hosting, databases, AI processing, and payments. Those services may have separate terms, availability limits, and policies. We are not responsible for third-party products or events outside our reasonable control, but we select and use providers to operate the CallCatch service.

8. Fees and Subscriptions

CallCatch offers monthly subscription plans. The plan price, included usage, and other purchase details presented on the pricing page and at checkout apply to the subscription you select. Fees and plan features may change prospectively, with notice when required.

Published plans state that there is no setup fee and that customers may cancel at any time. Contact support for billing or cancellation help. These Terms do not create a refund, credit, trial, or service-level promise beyond what is expressly shown at purchase or separately agreed in writing.

9. Intellectual Property

CallCatch, including its software, design, branding, documentation, and related materials, is owned by Call Catch LLC or its licensors and is protected by applicable intellectual-property laws. Subject to these Terms and payment of applicable fees, we grant customers a limited, non-exclusive, non-transferable right to use the service for their internal business purposes.

Customers retain rights in the business content they submit. They grant us permission to process that content as needed to provide, protect, and improve the service and meet our obligations under these Terms.

10. Service Availability

We work to keep CallCatch available and reliable, but the service may be interrupted by maintenance, carrier or vendor outages, network issues, security events, or other circumstances. Unless separately agreed in writing, we do not promise uninterrupted service, a specific uptime, or a guaranteed response time.

11. Termination

A customer may stop using CallCatch and may cancel a subscription as described in the service or with support assistance. We may suspend or terminate access when reasonably necessary for nonpayment, a material breach of these Terms, unlawful or unsafe use, risk to the service or others, or a third-party platform restriction. Where practical, we will provide notice and an opportunity to address the issue.

Provisions that by their nature should continue after termination—such as payment obligations, intellectual-property protections, disclaimers, liability limits, and indemnification—will continue to apply.

12. Disclaimers

To the extent permitted by law, CallCatch is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

CallCatch does not guarantee that every call will connect, every message will be delivered, every lead detail will be accurate, or use of the service will satisfy every law or carrier requirement. Customers remain responsible for reviewing their use and obtaining appropriate legal or compliance advice.

13. Limitation of Liability

To the fullest extent permitted by law, Call Catch LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, arising from or related to CallCatch. Nothing in these Terms limits liability that cannot lawfully be limited or excluded.

14. Indemnification

To the extent permitted by law, a business customer will defend and indemnify Call Catch LLC from third-party claims, damages, and reasonable costs arising from the customer’s unlawful content or communications, material breach of these Terms, misuse of the service, or failure to obtain required consent. This obligation does not apply to the extent a claim was caused by Call Catch LLC’s own unlawful conduct or material breach.

15. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. When changes are material, we may provide additional notice. Continued use after the updated Terms take effect constitutes acceptance where permitted by law.
